“I”, “We”, “Us”, and “Our” refers to Nice Loans (ABN 77 433 152 617), Credit Representative Number 499665.

Nice Loans is aggregated through Vow Financial Pty Limited (ABN 66 138 789 161), Australian Credit Licence Number 390261.

2. Services We Provide

Nice Loans operates as a finance broker, acting on behalf of lenders to assist you with home loans, mortgage products, and other credit contracts. Our services include:

  • Providing information about available credit products and loan options
  • Assisting with loan applications and arranging offers from lenders
  • Acting as an intermediary between you and our panel of lenders
  • Helping you navigate the loan application process

Important: We do not provide legal or financial advice regarding the implications of entering into credit arrangements. We recommend you seek independent professional advice regarding the suitability of any loan product for your specific circumstances.

3. Our Panel of Lenders

We have established relationships with a panel of lenders who have authorised us to arrange credit on their behalf. Our panel of lenders does not necessarily represent all lenders in the market who offer the type of credit you seek.

We may consider working with lenders outside our standard panel, provided they:

  • Work with credit representatives and brokers
  • Consent to our accreditation requirements
  • Meet our service standards and those of Vow Financial

4. Fees and Charges

Fees Payable by You

For most standard residential home loans, no fees are payable by you to Nice Loans. We receive commission payments from lenders for arranging your loan.

We may charge a brokerage fee for:

  • Commercial loans
  • Short-term or bridging loans
  • Complex loan scenarios
  • Loans where we will not receive industry-standard commission
  • Situations where lender commissions may be clawed back

Transparency Commitment: Any fees charged by Nice Loans will be clearly disclosed to you in writing before you proceed with your application.

Processing Fees

In limited circumstances, we may charge a processing fee for work completed if you have acted in an unethical manner, including but not limited to:

  • Providing false or misleading information
  • Failing to disclose material facts
  • Breaching your obligations under this agreement

5. Refund Policy

Brokerage Fees

If we charge you a brokerage fee and are unable to obtain loan approval for you, we will refund the fee to your nominated bank account.

Program Fees

Any program fees charged for specific services (such as pre-purchase consultation programs) will have their refund terms clearly disclosed at the time of payment. Generally:

  • Fees may be refundable if you proceed to use our services for a loan within a specified timeframe
  • Fees may be non-refundable for advisory services already rendered
  • Specific refund terms will be provided in writing when the fee is charged

6. Commission and Remuneration

Payments We Receive

Nice Loans may receive:

  • Upfront Commission: Between 0% and 2.2% of the loan amount (including GST)
  • Ongoing Trail Commission: Between 0% and 0.5% of the outstanding loan balance (including GST)

These commissions are paid by lenders and do not cost you anything additional.

Referral Fees

We may pay referral fees to individuals or companies that refer clients to us. This does not affect the service you receive or the loan products available to you.

Our Commitments

We confirm that:

  • We do not determine or set the conditions of credit contracts (interest rates, fees, loan terms)
  • All financial benefits and relationships that could influence our recommendations will be disclosed
  • We will inform you if commission arrangements change after making a recommendation but before you enter into a loan contract

7. Your Obligations and Acknowledgments

By engaging Nice Loans, you acknowledge and agree that:

  1. Accurate Information: The information you provide is true, accurate, and complete. We will rely on this information when arranging your loan.
  2. Independent Advice: You understand that Nice Loans does not provide legal or financial advice, and any information we provide is general in nature. You are responsible for obtaining independent professional advice regarding:
    • Legal implications of the loan
    • Financial suitability for your circumstances
    • Tax implications
  3. Affordability: You can make the loan repayments without undue hardship over the loan term.
  4. Income Declaration: If applying for a low-documentation loan, all income declared is true and correct.
  5. Indicative Terms: Loan terms discussed are indicative only and subject to lender approval. Final terms will be detailed in your loan contract from the lender.
  6. Lender’s Decision: Lenders have final approval authority and may:
    • Decline applications
    • Withdraw pre-approvals
    • Cancel unconditional approvals in certain circumstances

8. Limitation of Liability and Indemnity

You agree to release, indemnify, and hold Nice Loans harmless from any loss, damage, cost, or injury arising from or related to:

  • This agreement
  • The services we provide
  • Your loan application or loan contract
  • Any reliance on information we provide

This indemnity does not apply to losses caused by our negligence, fraud, or willful misconduct.

9. Privacy and Personal Information

Our Commitment to Your Privacy

We understand that the details you provide us are private and personal. We are committed to protecting your privacy in accordance with the Australian Privacy Principles set out in the Privacy Act 1988 and any other relevant law.

What is Personal Information?

Personal information means information from which your identity is reasonably apparent. This may include:

  • Your name, date of birth, and address
  • Account details and occupation
  • Contact information
  • For loan applications: number and ages of dependents and cohabitants, length of time at current address, employment details, proof of earnings and expenses
  • Credit information (finance outstanding, repayment history, defaults)
  • For insurance applications: health information (with your consent only)

Why We Collect Your Information

We collect personal information to:

  • Assess your application for finance and manage that finance
  • Create and manage your account via our website
  • Manage our relationship with you
  • Provide you with information about other products and services
  • Comply with legal and regulatory obligations

How We Collect Your Information

Where reasonable and practical, we collect your personal information directly from you. We may also collect information from:

  • Finance brokers
  • Accountants and lawyers

Before disclosing your information, we will take reasonable steps to ensure the recipient has a commitment to protecting your personal information at least equal to ours, or that you have consented to the disclosure.

Cloud Storage and Overseas Disclosure

We may use cloud storage to store your personal information. The cloud storage and IT servers may be located within or outside Australia.

Credit Reporting

You authorise Nice Loans to:

  • Obtain your consumer and commercial credit information from credit reporting agencies
  • Act as your agent in obtaining credit information for yourself and any related entities
  • Lodge information about credit defaults with credit reporting agencies if fees remain unpaid for more than 60 days and exceed $100

Government Identifiers

If we collect government identifiers (such as your tax file number), we will only use or disclose this information as required by law. We will never use a government identifier to identify you.

Sensitive Information

We will only collect sensitive information about you with your consent. Sensitive information includes information relating to your racial or ethnic origin, political persuasion, memberships in trade or professional associations or trade unions, sexual preferences, criminal record, or health. We will not collect sensitive information that is not required for obtaining finance.

Marketing

We may use your personal information to provide you with information about finance, offers, changes to our organisation, or new products and services offered by us or associated companies.

Updating Your Information

It is important that the personal information we hold about you is accurate and up to date. During our relationship with you, we may ask you to inform us if your personal information changes. You may contact us at any time to update your information.

Access and Correction

You may request access to the personal information we hold about you at any time. We may charge a fee for our costs of retrieving and supplying the information.

We will generally respond to your request:

  • Immediately for simple requests
  • Within seven days for other requests
  • We may need to contact other entities to properly investigate your request

There may be situations where we are not required to provide access, such as:

  • Information relating to existing or anticipated legal proceedings
  • If your request is vexatious

If any personal information we hold is incorrect, inaccurate, or out of date, you may request that we correct it. We will:

Our website calculators provide estimates only and:

  • Use calculation methods similar to major lenders
  • Are only as accurate as the information you enter
  • Do not constitute loan approval or guarantee eligibility
  • May contain errors or be based on outdated information

If you experience difficulty making loan repayments, contact your lender immediately. Lenders may:

  • Charge default interest rates (typically 2-4% p.a. above standard rates)
  • Charge enforcement and legal costs
  • Take action to recover funds, including selling secured property
  • Demand immediate repayment of the outstanding debt
  • Report defaults to credit reporting agencies
  • Seek court judgments against you

Each lender has specific hardship and collection policies. We are not involved in debt collection, which is the lender’s responsibility.

Financial Hardship Assistance

Most lenders offer hardship assistance programs. Contact your lender early if you anticipate repayment difficulties.

13. Fixed Rate Loans

If you have a fixed rate loan:

  • The fixed rate applies for the specified fixed term only
  • When the fixed period expires, you may refix or convert to a variable rate
  • If you take no action, most lenders will automatically convert your loan to their standard variable rate
  • As our client, you may contact us to discuss your options when your fixed rate period is ending

Refer to your lender’s loan contract for specific fixed rate renewal policies.

14. Changes to Terms and Conditions

Nice Loans reserves the right to update these terms and conditions at any time. Changes will be posted on our website with an updated “Last Updated” date. Your continued use of our services after changes are posted constitutes acceptance of the updated terms.

For material changes affecting existing clients, we will make reasonable efforts to notify you directly.

15. Governing Law

These terms and conditions are governed by the laws of the Commonwealth of Australia and the State or Territory in which you reside. Any disputes arising from these terms will be subject to the jurisdiction of the courts of that State or Territory.

16. Severability

If any provision of these terms and conditions is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
